Saunders Partner attends IBA 11th Transnational Crime Conference

Regulatory and Business Crime Partner and International Bar Association member, Stephen Gilchrist, represented Saunders Solicitors LLP at the IBA 11th Transnational Crime Conference in London. Attended by some of the leading lawyers in the field nationally and internationally, the conference provided some hard hitting and provocative presentations on some important hot topics.

After the conference was opened by Sir Ken Macdonald QC Director of Public Prosecutions for England and Wales the first day’s session concentrated on an examination and comparison of how financial regulatory systems operate in the United States, United Kingdom and Europe and the principles which lie behind those systems.

The speakers included the new Director of the Serious Fraud Office, Richard Alderman, Tracey McDermott, Head of Wholesale Enforcement with the Financial Services Authority and Alice S Fisher Former Assistant Attorney General, Criminal Division, US Department of Justice, in Washington DC.

In particular Ms McDermott flagged up the current hot topics of immunity and plea-bargaining, and the use of criminal proceedings as part of the regulatory process.

The first day concluded with an extremely entertaining and instructive mock hearing in Court 1 at the Central Criminal Court in which the unlucky participant playing the Defendant, ‘John Bull’, had to contend with an allegation of trying to con potential investors with misleading statements about the finances of his company. The learned judge, however had some sympathy for him and, despite his plea of guilty, took the view that principal culpability lay with his partner, a self assured and some what arrogant lady, ‘Jane Doe’, who had a penchant for Armani! All actors and participating counsel acquitted themselves well!

The second day started with a discussion on the developing law of corporate and individual criminal liability and centered on a discussion around the recent successful prosecution of the Commissioner of the Metropolitan Police in London for health and safety offences following the post 21/7 death of Jean Charles de Menezes at Stockwell tube station. Claire Montgomery QC (who represented the Metropolitan Police in that case) delivered a powerful and succinct paper on this subject.

The conference concluded with a discussion on recent issues arising from international conflicts, with a particular focus on due process and the trials of those accused of war crimes, offences committed by serving military personnel and breaches of international sanctions.

All in all, a conference where passion and intellect were equally matched and which provided a significant opportunity for Stephen to meet old and new friends to discuss important issues in an international perspective.
