Civil Litigation is an expensive way to sort out disputes and so best avoided if at all possible, but sometimes you have to fight for what is yours or what is right.
Litigation comes in many flavours and this page links to the six areas of work for which we are particularly known In fact there is almost no limit to the issues that can be taken to Court, so we invite clients to discuss problems with us when a dispute looms.
Where the issues in a case are complex, we are happy to talk to clients on a no obligation basis at an exploratory meeting. Large or complex cases will likely involve a long journey together, and as Napoleon Bonaparte said –
“Time spent in reconnaissance is rarely wasted”
Actions may be tried in the High or County Court, at a tribunal or arbitrated or mediated. Often there is a core money claim; there may be an associated injunction – an order to do, or not do, something. We are able to deal with injunctions urgently, as the Courts often require, and when urgent we will apply to the Courts without notice to the other party.
We are experienced in taking cases to the Administrative Court for Judicial review of administrative decisions. There are seemingly endless quangos and committees trying to run our lives, but their authority can be challenged if their decision is unreasonable or outside their power.
We have a department that claims compensation for torts, which are civil wrongs. These include actions for wrongful conduct of Police and other authorities, damages for personal injuries incurred in accidents, and compensation for loss caused by negligent lawyers and other professionals.
