Record-Breaking Police Caution Deletion for US-Based Client
Background
In 2002, our client received a police caution for Battery contrary to section 39 of the Criminal Justice Act 1988. Twenty-three years later, this caution was affecting their mental health, creating uncertainty about their status in the United Stated, and significantly impacting their successful career.
Our Approach
After reviewing all of the available documents and taking detailed instructions from our client, Saunders Law prepared an application for record deletion. We argued that retaining the caution was no longer in the public interest presenting the following arguments:
- At the time of the incident, our client was young and naïve
- Our client never understood that he was accepting a police caution
- The full implications of accepting a police caution were not properly explained to them
- The police caution was causing significant harm to our client’s mental health
- As a US resident, the caution created ongoing uncertainty
- Despite Our client’s professional success, the caution continued impacting their career
Outcome
Saunders Law submitted an application in September 2025. Within just 10 days, we received the successful outcome. This was our fastest successful outcome on record.
The case was handled by solicitor Amber Richardson, supervised by Ali Parker.
