Saunders Law does it again. Successful application to delete two police cautions
Our client was issued with two simple cautions by Metropolitan Police for the following offences in 2007:
a) Common assault contrary to section 39 of the Criminal Justice Act 1988
b) Criminal Damage contrary to section 1 of the Criminal Damage Act 1971
After nineteen years our client instructed us to make an application for record deletion of the two cautions. After reviewing all of the available documents and our client’s instructions, Saunders Law made an application for record deletion under the following grounds:
No Crime
Whilst our client admitted criminal damage, he did so with a lawful excuse and therefore had a defence under section 5 of the Criminal Damage Act 1971. He caused the damage in attempt to protect himself from harm.
Public Interest
- At the time of both incidents our client was young and living in a toxic environment
- Both offences were relatively minor domestic matters
- The cautions were having a huge impact on his life
- The cautions were restricting our client’s ability to relocate to live with his wife
- The cautions were limiting our client’s ability to progress in his career
- The constant fear of the cautions being disclosed caused our client’s mental health to deteriorate
- It had been over nineteen years since the cautions were issued and our client had been punished enough, and
- The full implications of the cautions were never explained to our client
Saunders Law made the application in April 2026 and, refreshingly within three weeks, we received the successful outcome. Our client is now free to move on with his life and start a family. The case was conducted by solicitor Amber Richardson, supervised by Ali Parker.
