Saunders Law gets another police caution deleted.

A police caution (now known as a ‘simple caution’) is a formal alternative to prosecution for minor criminal charges. It might look an easy way out at the time, but it becomes disclosable by police in a CRO check.  It can affect your job prospects if you want to be a teacher or stop you from getting a USA visa.

Saunders Law acts for clients who have been wrongly issued with a police caution or who have accepted a caution after being misinformed of the law.

Saunders recently secured the deletion of a simple caution and all personal data held by the police on behalf of our client, L. 


L was issued with a caution in 2015 for the offences of ABH and criminal damage. The incident arose after L was locked out of her home following an argument with her sister. She attempted to get back into her sister’ house to collect her property, which resulted in the front door being broken and scratches to her sister’s wrist and chest and the police being called.

Saunders Law made an application for deletion of the simple caution from the Police National Computer on L’s behalf for the following reasons:

  1. There had been a breach of PACE (Police and Criminal Evidence Act 1984)
  2. Misleading explanations were given in the interview
  3. The effect of a caution was not correctly explained
  4. There was no realistic prospect of conviction

Our application was successful, and the caution has been removed from L’s record. She is a dental nurse and now that her record has been cleared, she can go on to further studies.

Being interviewed at a police station can be very stressful and terrifying, and many are pressured into accepting a caution when there is no real prospect of being convicted. Anyone accused of crime should have legal representation at the police station.
