Successful Record Deletion for China-based Client
Background
In 2010, our client received a Conditional Caution for destroying or damage property (value of damage £5,000 or less) contrary to section 1 of the Criminal Damage Act 1971. Fifteen years later, this caution remained on record causing significant distress and professional complications for our client, who has built a successful business in China.
Our Approach
After reviewing all of the available documents and our client’s instructions, Saunders Law made an application for record deletion. We argued that retention of the caution was no longer in the public interest, and we made the following arguments:
- Our client was young and naïve at the time of the incident
- Our client was intoxicated during the incident, which impaired their judgement
- The full implications of accepting a police caution were never properly explained
- The caution was causing severe harm to our client’s mental health
- As a resident of China, the police caution created ongoing uncertainty
- The police caution threatened to impact the future of our client’s family home and was threatening the client’s successful career
Outcome
Saunders Law made the application in July 2025, and we secured a successful deletion in September 2025. The case was handled by solicitor Amber Richardson, supervised by Ali Parker.
