Saunders Law success against SRA
James Saunders is a longstanding member of the Solicitors Assistance Scheme which helps solicitors being investigated or disciplined by the SRA, or prosecuted by them at the Solicitors Disciplinary Tribunal (SDT).
Saunders Law recently represented the senior partner of a substantial conveyancing firm accused by the SRA of professional misconduct for accepting a Power of Attorney without further enquiry of its donor. The SRA criticised the compliance procedures adopted and served a Notice recommending a financial penalty under rule 2.3 of the Regulatory and Disciplinary Rules, and the publication of a critical notice.
Saunders Law were instructed to make representations in response to this recommendation. We found relevant fresh evidence and strongly challenged the suggestion that our client had brought the profession into disrepute. The adjudicator did not accept the SRA’s findings, nor impose any penalty or sanction, nor award costs to the SRA.
