Driving Instructor Cleared by DVSA After Online Campaign Fostered Multiple Complaints
Our client is an Approved Driving Instructor (ADI) for whom we previously acted in 2023 following allegations that were made that he:
- Had inappropriate conversations with the student in relation to his sexual encounters,
- Acted inappropriately throughout the lessons,
- Failed to allow the student to use their own vehicle during a test, and
- Used their mobile phone during lessons.
Our client denied these allegations. We successfully represented our client and made representations to the DVSA, which both disputed the allegations and showed him to be a professional and competent driving instructor. That matter was taken no further in 2023.
In 2026, the client instructed us again after receiving a further enquiry from the DVSA. The DVSA raised concerns as to whether he was a ‘fit and proper person’ to remain an ADI. This was due to his Enhanced DBS certificate which stated that he was currently under Police investigation following four allegations of sexual assault from separate students. It is alleged that the assaults took place during driving lessons whilst he was acting as an ADI.
We successfully represented our client in refuting those allegations and showing a degree of collaboration between the parties during an online campaign. For each allegation, we were able to demonstrate irregularities.
Furthermore, the DVSA had previously interviewed our client in relation to these four allegations, determining that ‘No Further Action’ needed to be taken in 2024. The fact that the same allegations had subsequently been made to the police did not constitute new evidence. It was our submission that, in the absence of either cogent new evidence, or criminal charges being brought, it would be irrational for the DVSA to backtrack on their 2024 decision. Ultimately, we were successful in our submissions and the DVSA concluded, in mid-2026, that our client remains a fit and proper person to remain an ADI.
